# Privacy Policy

## Data Society: Introduction

Data Society Group (Data Leaf Buyer, LLC) and its affiliated brands, including Data Society (DSQuorum LLC d/b/a Data Society) (together, "Data Society Group," "we," "us," or "our"), respect your privacy and are committed to protecting it. This privacy policy (the "Policy") explains what personal information we collect when you visit [datasocietygroup.com](https://datasocietygroup.com), [datasociety.com](https://datasociety.com), or any other website, email, or digital property that links to this Policy (our "Website"). It also explains how we use, share, keep, and protect that information, and the rights and choices you have. Affiliated brands that post their own privacy policy, such as CDO Magazine, are governed by that policy instead.

For the purposes of the EU and UK General Data Protection Regulation (GDPR), Data Society Group is the controller of the personal information described in this Policy. Under U.S. state privacy laws, it is the "business" or "controller." This Policy is also our notice at collection under the California Consumer Privacy Act (CCPA). Personal information collected when we deliver training, advisory, or custom solutions to a client organization (the "Services") is governed by our agreement with that organization and, where applicable, a data processing agreement. In those cases, the client is usually the controller, and we act as its processor.

This Policy applies to information we collect:

- On this Website;
- In email, text, and other electronic messages between you and us;
- When you register for or attend our webinars, events, or conferences; and
- Through forms, surveys, downloads, and interactive tools offered on, embedded in, or affiliated with the Website (see Section 3.4).

It does not apply to information collected by any third party, including through websites, applications, or advertisements that link to or are accessible from our Website. Those third parties have their own privacy policies, and we encourage you to read them.

Please read this Policy carefully. If our practices differ from this Policy for a specific activity, we will tell you when we collect your information.

## 1. Changes to This Policy

We may update this Policy from time to time. We will post the revised Policy on this page and change the "Last updated" date above. If we make material changes, we will notify you by email or by a prominent notice on the Website before the changes take effect. Where the law requires your consent to a change, we will ask for it.

## 2. Children's Privacy

Our Website is intended for professionals and is not directed to anyone under 18. We do not knowingly collect personal information from anyone under 18, including children under 13 protected by the U.S. Children's Online Privacy Protection Act (COPPA). We do not sell or share the personal information of anyone we know to be under 18.

If you are under 18, please do not use the Website or give us any information about yourself. If we learn that we have collected personal information from a child without the required consent, we will delete it promptly. ## 3. Information We Collect and How We Collect It

Personal information means any information that identifies, or can reasonably be linked to, an individual. It does not include information that has been de-identified or aggregated so that it can no longer identify you.

We do not ask for sensitive personal information, such as health data, government ID numbers, or information about race, religion, or sexual orientation. Please do not submit it through the Website or our Tools. If you create an account, we collect your login credentials, which some U.S. state laws treat as sensitive. We use them only to give you access. Payment card details are collected and processed directly by our payment processor, and we do not store full card numbers.

We may create aggregated or de-identified data, such as the share of visitors who use a feature. If we combine it with information that identifies you, we treat the result as personal information under this Policy.

### 3.1 Information You Provide to Us

- Information you enter in forms, including when you subscribe, download content, register for an event, or request a consultation.
- Records of your correspondence with us.
- Your responses to surveys, including research surveys such as our Data and AI Readiness Report.
- Details of purchases or registrations you complete through the Website.
- Comments or other content you post on public areas of the Website ("User Contributions"). User Contributions may be seen by others, so please share them with care.

### 3.2 Information We Collect Automatically

When you use the Website, technical and usage data is collected by Data Society and our service providers. We use it to operate and secure the Website, understand how it is used, remember your preferences, and improve our content. These technologies include:

- **Cookies.** Small files stored on your device. Strictly necessary cookies make the Website work. Analytics, functional, and advertising cookies are used only as described in our cookie banner and Section 3.5.
- **Pixels and web beacons.** Small images in pages and emails that tell us whether a page was visited or an email was opened.
- **Similar technologies.** Such as local storage and software development kits.

Where the law requires it, including in the European Economic Area (EEA), the UK, and Switzerland, we place non-essential cookies only after you consent through our cookie banner. You can change or withdraw your consent at any time through the Cookie Settings link at the bottom of this page.

### 3.3 Third-Party Cookies and Interest-Based Advertising

Some analytics and advertising partners, such as Google Analytics, LinkedIn Insight Tag, HubSpot, Meta (Facebook) Pixel, etc., may set their own cookies to collect information about your activity over time and across websites. They may use them to measure performance and show you ads based on your interests. These partners' use of the information is governed by their own privacy policies. We use advertising cookies only with your consent where the law requires it, and you can opt out at any time as described in Section 9.

You can opt out of interest-based ads from participating companies through the [Network Advertising Initiative](https://optout.networkadvertising.org), the [Digital Advertising Alliance](https://optout.aboutads.info), or, in Europe, [Your Online Choices](https://www.youronlinechoices.eu).

These industry opt-outs work per browser and device, so you need to set them on each one. You may still see ads that are not based on your interests.

### 3.4 Information Collected Through Our Tools

Our Website offers, embeds, or links to interactive tools ("Tools"). Tools may be operated by Data Society Group or by third parties on our behalf. These may include:

- Self-assessments, readiness assessments, quizzes, and benchmarking tools;
- Calculators, planners, and other interactive resources;
- AI-powered chat assistants, search, and content generators;
- Learning platforms, course portals, and sandbox or lab environments;
- Embedded scheduling, webinar, registration, and form tools; and
- Browser extensions, templates, or downloadable apps we make available.

**What we collect.** When you use a Tool, we may collect what you enter or upload (such as answers, prompts, questions, and files), the results the Tool generates, your account or registration details, and technical and usage data about how you use the Tool.

**How we use it.** We use this information to run the Tool and deliver your results, to save your progress, to secure and improve the Tool, and to produce aggregated or de-identified insights. We use Tool information for marketing follow-up only as described in Section 4 and in line with your choices.

**AI-powered Tools.** We label AI-powered Tools, so you know when you are interacting with AI. Some of them use AI models provided by third parties. Your inputs and outputs may be sent to those providers to generate responses. They are bound by contract to use the information only to provide the service and not to train their models on it. AI outputs may be inaccurate and are not professional advice. Please do not enter sensitive personal information, confidential business information, or information about other people into an AI Tool. We keep chat logs and inputs for 30 days unless a longer period is needed for security or legal reasons.

**Third-party and affiliated Tools.** Some Tools are hosted by third parties or on affiliated Data Society Group websites. When a Data Society Group company operates the Tool, this Policy applies unless that Tool displays its own privacy notice. When an independent third party operates the Tool, its own privacy policy also applies to what it collects, and we receive only the information it shares with us. We encourage you to review those policies before using the Tool.

**Client-provided Tools.** If you access a Tool through your employer or another organization that has contracted for our Services, that organization's agreement with us governs your information, and we process it on the organization's behalf.

### 3.5 Cookies We Use

This section is our cookie notice. We group the cookies and similar technologies on our Website into the categories below. Our cookie banner, provided through HubSpot, lets you accept or reject each non-essential category, and you can change your choice at any time through the Cookie Settings link at the bottom of this page.

- **Strictly necessary.** Needed for the Website to work and to remember your cookie choices, such as HubSpot's cookie preference cookie (kept up to 6 months). These cannot be turned off.
- **Analytics.** Help us count visits and understand how people use the Website, such as HubSpot analytics cookies (kept from the end of your session up to 6 months) and Google Analytics cookies (kept up to 2 years).
- **Functional.** Remember your preferences and support features such as chat, embedded forms, and scheduling tools (kept up to 13 months).
- **Advertising.** Measure our ads and show you relevant ads on other websites, such as LinkedIn Insight Tag cookies (kept up to 1 year) and Meta Pixel cookies (kept up to 3 months).

Our partners may change the names and lifetimes of their cookies when they update their tools. We review this section at least once a year.

## 4. How We Use Your Information and Our Legal Bases

We use personal information for the purposes below, for other purposes we describe when we collect it, or with your consent. Where the GDPR or similar laws apply, we rely on the legal basis shown.

Where we rely on legitimate interests, we have weighed them against your rights and freedoms. You can ask us for details of that assessment. Where we rely on consent, you may withdraw it at any time without affecting processing that took place before you withdrew.

We do not use your personal information for automated decision-making that produces legal or similarly significant effects on you. If we use AI tools to help analyze content or survey responses, we apply the same limits described in this Policy and do not use your personal information to train third-party AI models without your consent.

## 5. How We Disclose Your Information

**We do not sell your personal information for money.** However, our use of advertising cookies and pixels may count as a "sale" or "sharing" under some U.S. state laws, and you can opt out as described in Section 9. We may disclose personal information to:

- **Data Society Group companies**, including our affiliated brands, for the purposes in this Policy.
- **Service providers and processors** who help us run our business, such as hosting, email, CRM, analytics, event, and payment providers. They are bound by contract to use the information only on our instructions and to keep it secure. This includes professional advisers, such as lawyers, auditors, and insurers, who are bound by confidentiality duties.
- **Event sponsors and partners**: only when you register for a sponsored event or download sponsored content, we name the sponsors at that time, and you agree. You can decline.
- **Advertising and analytics partners**, through cookies and pixels as described in Section 3.3. Under some U.S. state laws this may be considered "sharing" for cross-context behavioral advertising or a "sale." You can opt out as described in Section 9.
- **A buyer or successor** in a merger, acquisition, financing, reorganization, or sale of assets, subject to this Policy.
- **Authorities and others** when required by law, court order, or government request, or when needed to protect the rights, property, or safety of Data Society Group, our users, or others.
- **Anyone else with your consent** or at your direction.

We may share aggregated or de-identified information that cannot reasonably identify you.

## 6. International Data Transfers

Data Society Group is based in the United States, and we and our service providers may process your information in the U.S. and other countries. Their data protection laws may differ from those in your country.

When we transfer personal information from the EEA, UK, or Switzerland to a country that does not have an adequacy decision, we use an approved safeguard. We rely on the European Commission's Standard Contractual Clauses, with the UK International Data Transfer Addendum and Swiss amendments where needed. Where a recipient is certified under the EU-U.S. Data Privacy Framework, its UK Extension, or the Swiss-U.S. Data Privacy Framework, we may rely on that certification instead. You may request a copy of the relevant safeguards by contacting us.

## 7. How Long We Keep Your Information

We keep personal information only as long as needed for the purposes in this Policy, unless the law requires a longer period. Our retention periods are:

| Correspondence | 3 years after last contact |

When information is no longer needed, we delete it or de-identify it.

## 8. Your Privacy Rights

Depending on where you live, you may have the right to:

- **Access** the personal information we hold about you and receive a copy.
- **Correct** inaccurate or incomplete information.
- **Delete** your personal information.
- **Port** your information to another provider in a commonly used format.
- **Object to or restrict** certain processing, including processing based on legitimate interests.
- **Opt out of direct marketing** at any time.
- **Opt out of targeted advertising, "sales," or "sharing"** of personal information, and of profiling for significant decisions.
- **Withdraw consent** where we rely on it.
- **Not be discriminated against** or retaliated against for exercising your rights.

**EEA, UK, and Switzerland.** You have the rights above under the GDPR, UK GDPR, and Swiss Federal Act on Data Protection. You also have the right to complain to your local data protection authority.

**U.S. states.** Residents of California (under the CCPA, as amended by the CPRA) and of other states with comprehensive privacy laws, such as Colorado, Connecticut, Virginia, Texas, and Oregon, have the rights listed above as those laws provide. In the past 12 months, we collected these categories of personal information as defined by California law: identifiers; professional or employment-related information; commercial information; internet or other electronic network activity; approximate geolocation; and inferences about your interests. We may have "sold" or "shared" identifiers and internet activity with advertising partners, as described in Section 5. We use account login credentials, which California treats as sensitive personal information, only to give you access, so the right to limit its use does not apply. California residents may also request information about disclosures for direct marketing under California Civil Code § 1798.83. Nevada residents may opt out of the sale of covered information, although we do not sell it.

**Other regions.** Residents of Canada, Brazil, Australia, and other countries may have similar rights under local law, and we will honor them as required.

**How to make a request.** Email [hello@datasociety.com](mailto:hello@datasociety.com) or submit our online [Privacy Request Form](https://dsmarketing.datasociety.com/privacy-policy#privacy-request). Before acting on a request, we will verify your identity by matching details you give us to information we hold. We respond within one month for requests under the GDPR and within 45 days for requests under U.S. state laws. Where the law allows, we may extend that period and will tell you why. An authorized agent may make a request for you where the law allows, and we may ask for proof of the agent's authority. If we deny your request, you may appeal by replying to our response with "Appeal." If we deny your appeal, you may contact your state attorney general. If you delete User Contributions, copies may remain in cached or archived pages or with other users.

## 9. Your Choices

- **Marketing emails.** Click "unsubscribe" in any marketing email or update your preferences. We may still send you transactional or service messages.
- **Cookies.** Use the Cookie Settings link at the bottom of this page or your browser settings to block or delete cookies. Some parts of the Website may not work without them.
- **Global Privacy Control.** We treat a Global Privacy Control (GPC) signal from your browser as a valid request to opt out of targeted advertising, sales, and sharing for that browser. We do not currently respond to "Do Not Track" signals, because no common standard for them exists.
- **Opt-out link.** You can also opt out of targeted advertising, sales, or sharing through our online [Privacy Request Form](https://dsmarketing.datasociety.com/privacy-policy#privacy-request), linked as "Your Privacy Choices" at the bottom of this page.

## 10. Data Security

We use administrative, technical, and physical safeguards designed to protect personal information from accidental loss and unauthorized access, use, change, and disclosure. These include encryption in transit, access controls, and vendor security reviews. No internet transmission is completely secure, so we cannot guarantee the security of information you send us. If a data breach affects your personal information, we will notify you and the relevant authorities as the law requires.
